“Trip for 2 to Hawaii” Sweepstakes
Official Rules. No Purchase Necessary To Enter or Win.
Eligibility: The “Trip for 2 to Hawaii” Sweepstakes (“Sweepstakes”) is open to legal residents, 18 years of age or older at the time of entry, of the United States (including the District of Columbia and Hawaii), Puerto Rico and Canada except employees, officers, directors (and their immediate families and those living in their same households) of Spirit Halloween Superstores LLC (hereafter “Sponsor”), Void in The U.S. Virgin Islands, U.S. military installations in foreign countries & all other U.S. territories and possessions and where otherwise restricted or prohibited by law.
Three (3) Ways to Enter: Between September 1, 2008 at 12:00:01 AM Eastern Time (“ET”) and November 1, 2008 at 11:59:59PM ET, 1) go to any Spirit Halloween retail store, purchase merchandise and provide your email address at the register; 2) go online to www.SpiritHalloween.com, make a purchase and provide your email address, OR 3) go online to www.SpiritHalloween.com and follow the Sweepstakes instructions to submit an online entry, including entering all required information. All entries must be received by November 1, 2008 at which time this sweepstakes ends. ANY MAIL-IN ENTRIES SUBMITTED WILL NOT BE ACCEPTED, WILL BE VOID AND AUTOMATICALLY DESTROYED WITHOUT OPENING. Only one entry per person, per day will be accepted. Use of any automated system to participate is prohibited and will result in disqualification. Incomplete, illegible, false or deceptive entries are void. All entries become property of Sweepstakes Parties and will not be acknowledged. Sweepstakes Parties are not responsible for interrupted or unavailable network, server or other connections, computer or software malfunctions or telephone transmission problems or technical failures, garbled transmissions, damage to a user's computer equipment (software or hardware) or other errors or malfunctions of any kind whether caused by computer viruses, worms or bugs, tampering, unauthorized intervention, fraud, equipment, programming used in this Sweepstakes, mechanical, electronic or human error or otherwise. In the event of a dispute as to any registration or play, the authorized account holder of the e-mail address used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder. By participating, entrants agree to abide by these Official Rules & to the decisions of the judges, which shall be final & binding in all matters relating to this Sweepstakes.
Drawing: Winner will be selected in a random drawing occurring on or around November 10, 2008 from all eligible entries of valid e-mail addresses received within the time limits specified in these Official Rules and the will be notified by email only. Failure by a to respond to such notification within fifteen (15) business days from the date of the sweepstakes drawing will result in disqualification and an alternate winner will be selected. Sweepstakes Parties reserve the right to modify the notification procedures in connection with the selection of the alternate winner(s), if any. Acceptance of any prize constitutes the prize winner’s permission for Sweepstakes Parties to use such person’s name, picture, likeness and address for promotional or advertising purposes in connection with this Sweepstakes without further compensation or permission except where prohibited by law. All entries are subject to verification prior to awarding of prizes. Eligibility, age, and claims made by prize winners also are subject to verification prior to awarding of prizes.
Prize: Winner will receive a prize package which consists of the following items; (i) a trip for winner and one guest to Hawaii, including: round trip coach class airfare from a commercial airport near winner’s residence, as selected by Sponsor; (ii) five (5) nights at Waikiki Beach, Honolulu, Hawaii-, standard room;. Any and all taxes on the prize, and any other costs, fees, and expenses not explicitly stated herein (including, but not limited to, meals and gratuities), are the sole responsibility of the prize recipient. The winner and guest must travel together. Travel must be completed by November 10, 2009. Travel will be coordinated through Pleasant Holidays’ Corporate Travel Department. Travel over holidays and other peak travel periods is restricted. Travel is subject to availability at the time of booking, and blackout dates apply and other restrictions may apply. This trip is non-transferable, non-refundable, may not be sold and has no refund value. Airline tickets must be used on the carrier ticketed and cannot be used on any other airline. Every attempt will be made to offer first choice of reservations. Spirit Halloween needs thirty (30) days to process reservations. All requests must be received from the winner. Once a reservation has been confirmed by Pleasant Holidays, subsequent changes or cancellations will be subject to fees by the winner: Travel during major holiday periods is prohibited [Easter, Memorial Day, 4th of July, Labor Day, Thanksgiving, Christmas, New Years]. Holiday blackouts begin two (2) weeks prior to a major holiday and end two (2) weeks after the major holiday.
Miscellaneous: No transfer, cash redemption, or prize substitutions (or portion thereof) allowed. In the unlikely event that any portion of the prize is cancelled or undeliverable for any reason, Spirit will award a substitute prize of equal or greater retail value. The potential winner will have twenty-one (21) days from the moment such notification is issued to respond to such notification by following instructions provided therein. If a potential winner responds to such notification in the time frame stipulated, the potential winner will be required to sign, notarize and return an affidavit of eligibility/liability and publicity release and proposed guest will be required to sign, notarize and return a liability and publicity release within twenty-one (21) business days of the notification being issued or prize will be forfeited and an alternate winner selected. Guest must be age 18 or older at the time of prize winner entry to participate. Return of any prize notification as undeliverable will result in disqualification and selection of an alternate winner. Sweepstakes Parties reserve the right to modify the notification procedures in connection with the selection of the alternate (s), if any. Acceptance of any prize constitutes the prize winner’s permission for Sweepstakes Parties to use such person’s name, biographical and prize information, entry materials, picture, and likeness for promotional or advertising purposes in connection with this Sweepstakes without further notice or further compensation or permission except where prohibited by law. All entries are subject to verification prior to awarding of prizes. Eligibility, age, and claims made by prize winners in regards to compliance with these official rules also are subject to verification prior to awarding of prize. Sweepstakes Parties will not replace any lost or stolen prize items once in the winner’s possession. Sweepstakes Parties shall not be liable to winner or any person claiming through winner for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, threatened terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sweepstakes Parties’ sole control (collectively, “Force Majeure Event”). Canadian entrant, if selected as the winner, must correctly answer, without assistance, a time-limited math question by telephone in order to be declared the winner. By entering, entrant agrees that Sweepstakes Parties & all of their respective officers, directors, employees, representatives & agents shall have no liability for, & shall be held harmless for & against any damage, loss or injury that may arise in whole or in part, directly or indirectly, from: (i) the acceptance, possession, use or misuse of prize or participation in this Sweepstakes; or (ii) printing, distribution or production errors. Sweepstakes Parties or their affiliates may rescind any promotion found to contain such errors without liability at their sole discretion. Sponsor makes no warranty, representation or guarantee, express or implied, in fact or in law, relative to the nature of any prize awarded. Sweepstakes Parties reserve the right, in their sole discretion to modify, cancel, terminate or suspend this Sweepstakes should causes beyond the control of Sponsor, including but not limited to a Force Majeure Event (as defined herein), impair the administration, security, fairness or proper play of the Sweepstakes &, in the event of cancellation, termination or suspension, select, at Sweepstakes Parties’ discretion, winners from eligible, non-suspect entries received prior to event requiring such cancellation, termination or suspension. Sweepstakes Parties reserve the right at their sole discretion to disqualify any individual that (i) tampers or attempts to tamper with the entry process or the operations of this Sweepstakes in any manner, (ii) violates the Official Rules, or (iii) acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: Any attempt by an entrant or any other individual to deliberately damage or undermine the legitimate operation of this sweepstakes is a violation of criminal and civil laws. Should such an attempt be made, sweepstakes parties reserve the right to seek civil and/or criminal prosecution and/or damages from any such person to the fullest extent permitted by law.
Jury Trial Waiver: Except as prohibited by law and as a condition of participating in this sweepstakes, entrant hereby waives any right it may have to a trial by jury in respect of any litigation directly or indirectly arising out of, under or in connection with this sweepstakes, any document or agreement entered into in connection herewith and any of the transactions contemplated hereby or thereby.

Governing Law & Jurisdiction: The conduct of this Sweepstakes & the application of these Official Rules shall be governed by the law of the state of New Jersey USA, whose courts shall have exclusive jurisdiction in the event that any dispute arises regarding the Sweepstakes or the prize.
